VI.3.2)Lodging of appeals
Precise information on deadline(s) for lodging appeals: Precise information on deadline(s) for lodging appeals: In accordance with current Public Contracts Regulations, the Council will incorporate a minimum of a 10 calender day standstill starting from the date when the award decision notification is dispatched to bidders.
This period allows unsuccessful bidders to seek further debriefing from the Council before the Contract is entered into. If an appeal regarding the award of the Contract has not been successfully resolved, the public contracts regulations provide for the aggrieved parties who have harmed, or at risk of harm of the consequence of breach of the Procurements rules to bring an action to the High Court.
Any such action must be brought promptly and in any event within 3 months of the date when the grounds of the complaint first arose.
The Court has the power to set aside the award decision and / or the contract (if it has been entered into) and may also award damages. The purpose of the standstill period referred to above EN Standard form 02 - Contract notice 12 / 16 is to allow parties to the Court to set aside award decision and / or the Contract (if it has been entered into) or request for damages to be awarded.
