This is a framework contract for the supply of trees, shrubs & roses to Leeds City Council. The estimated total value of this framework is 600 000 GBP. The framework will be run on a "call-off" basis and it will contain secondary calls for competition (quotes) when needed. Although Leeds City Council will be the local authority for the purposes of this procurement, all local authorities and / or public bodies in the Yorkshire and Humber region may choose to access the concluded framework agreement and order Goods, without creating any obligation on behalf of any of them to do so.
Where any such local authority and/or public body elects to place an order under the Framework Agreement a legally binding contract shall be created between the particular local authority and/or public body, and the Contractor at that time to which the terms of this Framework Agreement will apply.
This framework will be set up for a 2 year period with the option to extend for a further 2 x 12 month period.

Precise information on deadline(s) for lodging appeals: This authority will incorporate a minimum 10 calendar day standstill period at the point of information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into.
Applicants have 2 working days from notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before expiry of the standstill period. Such additional information should be requested from the addressee found in 1.1.
In an appeal regarding the award of a contract has not been successfully resolved, (for Public Sector), Public Contracts Regulations 2006 (SI2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months).
Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the court may only award damages.
