Award of a contract without prior publication of a contract notice in the Official Journal of the European Union (in the cases listed in Section 2 of Annexes D1, D2 or D3 as appropriate)
Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with art. 28 of Directive 2009/81/EC
The works/goods/services can be provided only by a particular tenderer for reasons that are: technical, connected with the protection of exclusive rights
It is considered that this Contract amendment can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011).
The ammunition is proprietary to Black Hills who is the Original Equipment Manufacturer and holder of the intellectual property rights. No licences have been granted to any party, including the MoD, to obtain the drawings, specifications and/or other intellectual property necessary to carry out the design or manufacture of these items. The ammunition is solely manufactured for and sold to the UK Government and Edgar Brothers are the sole distributor for Black Hills of this ammunition. The introduction of new rounds would need to be supported by a completely new Safety Case to provide the necessary confidence that the integrity of the rounds have not been compromised. This process would cause an untenable gap in current operational capability together with a disproportionate impact on time and cost.

The MOD SID is a database of active and potential suppliers available to all MOD and UK Defence procurement personnel, and is the main supplier database of MOD Procurement organisations. Please note: the registration and publication of a company profile on the MOD SID does not mean or imply that the supplier has in any way been vetted or approved by the MOD. Suppliers wishing to compete for advertised MOD contracts must respond to any specific call for competition by submitting a separate expression of interest in accordance with the instructions of the purchasing organisation.

From 2 April 2014 the Government is introducing its new Government Security Classifications Policy (GSC) to replace the current Government Protective Marking Scheme. A key aspect of this is the reduction in the number of security classifications used. All suppliers to the Department are encouraged to make themselves aware of the changes as it may impact on this Requirement. The link below to the Gov.uk website provides information on the new GSC.
