Weapons, ammunition and associated parts. Supply of Light Gun and A Vehicle Weapon Spares. Defence Support Group Land Supply Business Unit, part of the UK Ministry of Defence, seeks to place a non competitive contract with BAE Systems Global - Combat Systems Limited, Barrow in Furness for the Supply of Light Gun and A Vehicle Weapon spares. This will comprise an initial tranche of items and will for a period of up to 12 months after contract award include the addition of items that fall within the scope of the Contract. The Authority would seek competitive bids but is unable to do so because the drawing packs necessary to facilitate competition are not currently available to the Authority.

It is considered that this can be made using the Negotiated Procedure Without Prior Publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (the "Regulations”) on the basis of technical reasons. This is because BAE Systems Global - Combat Systems Limited, Barrow in Furness, in its capacity as Design Authority, uniquely possesses the technical know-how, expertise, tooling and equipment required to produce and manufacture the range of items to the latest build standard without the requirement of the drawings usually supplied by the Authority.
It is proposed that the additional items will be listed in an annex to the Contract so that when (and if) the drawings become available and it is possible to run a competition for the item(s), the relevant item(s) can be easily identified and removed from the Contract. The Authority commits that in the event that drawings for any of the additional items become available to the Authority for issue to potential bidders for tendering purposes, the relevant item(s) shall be removed from the Contract and competitive bids shall be sought in accordance with the Regulations.
