1) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC

The works/goods/services can be provided only by a particular tenderer for reasons that are:

The Air Commodities Team, part of the UK Ministry of Defence intends to place a contract with Muirhead Aerospace Ltd for a period of 4 years (commencing 01 January 2014) for repairs, spares and post design services in respect of the following avionics equipment: Covert Personal Locator Systems (CPLS), Weather Radar and Radio Compass Equipment.It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011)for technical reasons. The equipment which this contract concerns has all been in service for at least 20 years and has been supported and maintained by Muirhead Aerospace Limited for at least 10 years. It is considered that only Muirhead Aerospace Ltd has the technical expertise, including know-how, tooling and test equipment and access to drawings and data packs, which is necessary to support the equipment.
