1) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC

The works/goods/services can be provided only by a particular tenderer for reasons that are:
technical,
connected with the protection of exclusive rights
It is considered that this requirement can be placed using the negotiated procedure without prior publication as permitted by Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of UK Defence and Security Public Contracts Regulations). Cassidian Test and Services Limited hold the exclusive rights for GPDTDF, specifically the Rebate Controller and Editing System including multi-purpose interfaces, Recode - SABRE language and compiler, and Digital Application Test Equipment. For technical reasons, Post Design Services for GPDTDF can only be carried out by Cassidian Test and Services Limited. Cassidian Test and Services Limited are the only economic operator who has the necessity to use specific know how in order to carry out the works required for Post Design Services.
