VI.4.1)Body responsible for appeal procedures
VI.4.2)Lodging of appealsPrecise information on deadline(s) for lodging appeals: Without prejudice to the remedies provided under Regulation 47 of the Public Contracts Regulations 2006, the Council of the Borough of Milton Keynes shall allow a period of at least 10 days to elapse between the date of despatch of its decision notifying its intention to award the contract and the date on which it proposes to enter into a contract. If by midnight at the end of second working day of the above said period the Contracting Authority receives a request in writing from an economic operator who had been sent a notice of being unsuccessful, the Authority shall inform the said economic operator of characteristics and relative advantages of the successful tender. That information shall be provided at least 3 working days before the end of aforesaid 10 days standstill period. Where it is not possible the standstill period shall be extended to allow at least 3 working days between provision of the information and the end of standstill period. Such additional information should be required from the address part 1.1. If an economic operator is not satisfied with the information provided, the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
