1) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC

The works/goods/services can be provided only by a particular tenderer for reasons that are:
technical,
connected with the protection of exclusive rights
Defence Equipment and Support Group (DE&S;), part of the UK Ministry of Defence, proposes to let a Contract with Park Air Systems Ltd for the Continued Support of Park Air Radios. It is intended that a Contract shall be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii)of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons and for reasons connected with the protection of exclusive rights. Park Air Systems Ltd hold the exclusive rights required to provide this requirement as the Original Equipment Manufacturer and also exclusively have all of the expertise, know-how and documentation required to support the Radios.Park Air Systems are the sole producers of the Radios that require support under this Contract. Access to the technical design data for these radios is constrained through the protection of exclusive rights held by the OEM and they will not provide licence to use the technical data required to enable another Contractor to maintain the Radios. As such this requirement can only be carried out by Park Air Systems.The Contract is due to begin January 2014 and expire December 2020 - This includes 3 option years
