Additional works/deliveries/services are ordered under the strict conditions stated in the Directive.
It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 28 (3)(a) of Directive 2009/81/EC (Regulation 16 (1)(b)(i) of the Defence and Security Public Contracts Regulations 2011). This is because Ultra Electronics Limited is the current supplier of these items and a change of supplier will introduce material and different technical characteristics which will result in incompatibility difficulties in operating and maintaining the equipment together with a disproportionate impact on costs and logistics to ensure maintenance and operations.
