The Networks Commercial Beyond Line of Sight Team ("BLOS”), part of the UK Ministry of Defence ("MOD”) intends to award a contract to Mactaggart Scott and Company Ltd for the modification of existing Mast Raising Equipment (MRE) and the development of new variants of MRE for the Astute class submarine.
It is considered that this contract can be placed using the Negotiated Procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011.) Mactaggart Scott designed and manufactured the existing MRE and owns the design rights in the underlying technical information for the MRE including plans, designs and drawings. No licenses in this information have been granted and performance of this contract will require access to this proprietary information and other commercially confidential information. Therefore, for reasons connected with the protection of exclusive rights this contract may only be awarded to Mactaggart Scott.
