1) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC

The works/goods/services can be provided only by a particular tenderer for reasons that are:
technical
The Defence Support Group (DSG), as part of the UK Ministry of Defence, intends to award a three year contract to Inutec Ltd for the disposal of radioactive waste from DSG Donnington. It is considered that the contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 31(1)(b) of Directive 2004/18/EC (Regulation 14(1)(a)(iii) of the Public Contracts Regulations 2006). This is for technical reasons because the disposal of radioactive waste produced at DSG Donnington is controlled by Environment Agency permit number BY7938. That authorisation states that the material may only be transferred to 'The Operator of the B4 Complex on the Winfrith Nuclear Licensed Site for treatment and disposal via a permitted route'. The operator of the Complex is Inutec Limited and therefore that company is the only economic operator with the right to receive and dispose of the waste.
