1) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC

The works/goods/services can be provided only by a particular tenderer for reasons that are:
technical,
connected with the protection of exclusive rights
The DIST Team, part of the Ministry of Defence intends to place a three year contract with Active Risk Ltd for the renewal of the Active Risk Manager Licences, support and maintenance.It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011). This is for reasons connected with the protection of exclusive design rights in the software and for technical reasons linked to interoperability and safety implications. Active Risk is a proprietary software product owned wholly by Active Risk Ltd. No licences have been granted to the Ministry of Defence and the requirements cannot be provided for without access to these exclusive rights.
