The Joint Propulsion Team (JPT), part of Combat Air ("CA”) of the UK Ministry of Defence (the "MOD”) proposes to let a 5 year Contract (the "Contract”) with Rolls-Royce for the Repair and Overhaul ("R&O;”) support to 2 Marks of the MOD owned Hawk Engine fitted to the Hawk TMk1 and TMk2 Aircraft pursuant to Article 28(1)(e) of Directive 2008/81/EC (Regulation 16(1)(a)(ii) (exclusive rights and technical reasons) of the Defence and Security Public Contracts Regulations 2011 (the "Regulations”).
The MOD TMk1 Hawk Training Aircraft are used for both Fast-Jet Pilot Advanced Training and as a display Aircraft. They are fitted with either the Mk151-01 or Mk151-02 variation of the Adour Mk151 Engine. The Mk151-02 is the variation used by The Royal Air Force Aerobatic Team ("RAFAT”), also referred to as The Red Arrows. The MOD TMk1A Hawk Training Aircraft are used for Weapons and Tactical Training, Advanced Fast-Jet Weapons Systems Officer Training and Operational Support Flying. They are fitted with the Adour Mk151-01 Engine. The Rolls-Royce Turboméca Adour 151 Turbofan Engine is an un-reheated version of the Engine that powered the Jaguar GR3 Aircraft.
The MOD TMk2 Hawk Training Aircraft are fitted with the 6,500lbs static thrust Rolls-Royce/Turboméca Adour Mk.951 Turbofan with Full Authority Digital Engine Control (FADEC). The TMk2 was designed to introduce student pilots to the digital cockpit environment they will experience in front-line operational service and will provide a seamless transition between basic flying training, and operational conversion training onto advanced fighter Aircraft.
The 2 Engine marks are not interchangeable.
It is therefore considered that this Contract can be placed using the Negotiated Procedure pursuant to Article 28(1)(e) of Directive 2008/81/EC (Regulation 16(1)(a)(ii) of the Regulations) for reasons connected to the protection of exclusive rights. Rolls-Royce owns the copyright in relation to the drawings and Maintenance Manuals to manufacture both the Engine and spare parts for the R&O; Support. The MOD does not have a licence to use the exclusive rights attached to the drawings and Maintenance Manuals required to carry out the R&O; Support of the Engines which would enable it to seek competitive bids, and no third party, including the MOD, will be granted a licence to use these exclusive rights.
Further to this, technical reasons apply in that Rolls-Royce has at its disposal the specific know-how, tooling and equipment to provide the R&O; Support, including ownership of the only test bed for the TMk2 Engine.
