The Authority intends to award a contract to SERCO Limited for the modification of the MoD T92 Air Defence Radar at Remote Radar Head (RRH) Buchan to enable it to mitigate against interference caused by a windfarm proposed to be built nearby.
It is considered that this contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 28 e of Directive 2009/81/EC (Regulation 16 (1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011). This is because the windfarm developer has agreed to fund the mitigation solution for RRH Buchan and require, as a condition of that funding, that (i) a contract is entered into by the end of September 2013 and (ii) SERCO Limited act as prime contractor to manage the project. There are therefore technical reasons why the contract may only be awarded to Serco Limited.
