The Artillery Systems Team, part of the UK Ministry of Defence, intends to award BAE Global Combat Systems Limited a contract for the design, development and manufacture of a Drivers Console Unit (DCU) on the AS90 Howitzer as part of an obsolescence modification.
It is considered that this requirement can be placed using the negotiated procedure without prior publication as permitted by Article 31(1)(b) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons and reasons connected with the protection of exclusive rights. BAE Global Combat Systems Limited are the design authority and own the intellectual property rights for the platform and subsequent upgrades to it. The modification cannot be provided without access to that proprietary design information.
BAE Global Combat Systems Limited also have the equipment, specific technological expertise, tools and specialist test equipment to carry out the modification work and are responsible for specific interoperability and safety requirements. No other party has the necessary technical expertise and knowledge required to provide the modification.
