The Council wishes to award a framework agreement for the supply of musical instruments, accessories and consumables to assist the North Yorkshire County Council County Music Service with the continuation of our Wider Opportunities programme at Key Stage 2. This will provide a wide range of brass, woodwind, strings, keyboard and percussion/guitars for use in instrumental and curriculum class teaching across North Yorkshire.

This framework agreement is being advertised and tendered so it can be utilised by all Public Sector bodies (including schools) in the Yorkshire and Humber region as defined http://www.lgyh.gov.uk/About-Us/Our-members/ and registered UK Charities as identified through http://www.charity-commission.gov.uk/.

II.2.1)Total quantity or scope:
The Council wishes to award a framework agreement for the supply of musical instruments, accessories and consumables to assist the North Yorkshire County Council County Music Service with the continuation of our Wider Opportunities programme at Key Stage 2. This will provide a wide range of brass, woodwind, strings, keyboard and percussion/guitars for use in instrumental and curriculum class teaching across Yorkshire and Humber regions.
The total scope of the contract over the course of the agreement is expected to be in the region of GBP 80 000 pa. The contract is planned to operate for an initial period of 1 year with the Council having the option to extend the arrangement for periods of 1 year up to a total of 4 years.
North Yorkshire County Council spend, broken down by Lot is as follows:
Spend via the Assisted Purchase Scheme (NYCC Only):
- Lot 1 - Woodwind = GBP 39 718,82
- Lot 2 - Brass = GBP 12 301,20
- Lot 3 - Strings = GBP 102,50
- Lot 4 - Keyboards = GBP 3 153,11
- Lot 5 - Percussion and Guitars = GBP 8 335,14
The Council's County Music Service also used the framework agreement for in house requirements, spend for 2011/12 as follows: -
- Ukuleles = GBP 1 600
- General Instruments = GBP 1 300
- Percussion = GBP 2 500
- Cases/bag slings = GBP 300
- Reeds/strings/bows/leads = GBP 2 650
- Repairs = GBP 780

Council shall in accordancewith the Public Contracts (amendment) Regulations
2009, incorporate a minimum 10 day standstill periodcommencing at the point
that information on the intention to award the contract is sent to tenderers.
The Councilshall, as soon as possible after the decision has been made, inform
the tenderers and candidates of its decision,and shall do so by notice in
writing by the most rapid means of communication practicable. The information
willinclude; a) the criteria for the award of the contract b) the reasons for
the decision c) the name of the economicoperator to be awarded d) a precise
statement when the standstill period is expected to end.

paragraph 1.1 of this form.
If an appeal regarding the award of a contract has not been successfully
resolved, Public Contracts Regulations2006 (SI2006 No 5) provide for aggrieved
parties who have been harmed or are at risk of harm by a breachof the rules to
take action in the High Court (England, Wales and Northern Ireland). Any such
action must bebrought promptly (generally within 3 months).
Where a contract has not been entered into the court may order the setting
aside of the award decision or orderthe authority to amend any document and may
award damages. Following the 10 day standstill period, if nofurther debriefing
has been requested, the court may only award damages once the contract has been
enteredinto.
