HMRC wishes to procure legal services in respect of insolvency recovery and intervention.
The purpose of this Prior Information Notice (PIN) is:
a) To give potential tenderers advance notice that HM Revenue & Customs (HMRC) is considering undertaking a tendering exercise to set up a framework for the provision of legal services in respect of insolvency recovery and intervention.
b) To advise that due to changes to the provision of legal service enacted in the Legal Services Act 2007, businesses other than traditional firms of solicitors will be able to apply under the tender, which may result in alternatives to existing charging structures being identified.
c) To allow any organisation wishing to provide details of potential alternative charging structures they may be able to offer in respect of the outline requirement referred to above, and thereby assist in the development of the commercial specification, to do so by completing an online questionnaire that HMRC is preparing.
To obtain access to the proposed online questionnaire, please send an email entitled "Legal Services in respect of HMRC Specialist Investigations Unit" to containing the following information: organisation name; contact name; contact email address; and contact telephone number. When the online questionnaire is prepared, respondents will receive an email notification providing password access. Information about how long it will be open for will be provided at this time.
Please note (a) that non-completion of the online questionnaire will not disqualify organisations from participating in any future related tendering exercise and (b) that completion of the online questionnaire will not remove the need to respond to and fully comply with any future related Competitive Contract Notice and (c) that any information provided will only be visible to HMRC but may be considered in developing the commercial specification.

Subject to finalising the scope of the requirement and obtaining approval to proceed, it is intended that any tendering exercise will be conducted under a Part B "Open” type award procedure, with the relevant Competitive Contract Notice expected to be published in April or May 2013. Tenderers will be required to provide their Tender response electronically using the HMRC eSourcing system, which is a web based portal. Further details about the eSourcing system can be found in the Suppliers Guide for Selling to HM Revenue & Customs (HMRC) using the following link: http://www.hmrc.gov.uk/about/supplying.htm.

Interested parties may want to familiarise themselves with the content of the Suppliers Guide, which includes training on the use of the eSourcing system. Further details of the requirement will be provided in due course in any future Competitive Contract Notice and Tender documentation.

Full details regarding legal, economic, financial and technical information to be provided at the tender stage willbe detailed in the Competitive Contract Notice and in the tender documentation, but potential tenderers shouldbe aware that they may be required to forward the following information: (a) a copy of the most recent audited accounts covering the applicant's last 3 years of trading (or for the period that is available if trading for less than3 years) or (b) for the most recent full year of trading, where this information is not available in audited form,a copy of the draft or unaudited financial accounts or equivalent information showing the applicant's turnover,profit and loss and cash flow position and an end period balance sheet or, where this cannot be provided,a statement signed by the finance director or similar responsible person detailing.
