Extreme urgency brought about by events unforeseeable by the contracting authority and in accordance with the strict conditions stated in the Directive.
Deployed Diagnostics and Detection Purchase ContractThe CBRN DT, part of the Ministry of Defence, placed a contract with HazMAT Link Limited to purchase 17 FilmArray Polymerase Chain Reaction (abbreviated to PCR, meaning DNA Analysis) detection platforms.In recent months an unforeseeable change has been noted in the potential profile of illnesses experienced by service personnel in Afghanistan, which requires an urgent new diagnosis capability. The timescales required for the currently deployed diagnosis capability impact on the health of service personnel and undermine operational effectiveness. The new capability will be able to produce accurate and timely diagnostic data.It is considered that this contract can be placed with HazMAT Link Limited using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(d) of Directive 2009/81/EC(Regulation 16(1)(a)(iv) of the UK Defence and Security Public Contracts Regulations 2011). Tendering this requirement under the restricted or negotiated procedures with publication of a contract notice would result in the failure to deliver the equipment to theatre within the required timescale.
