The works/goods/services can be provided only by a particular tenderer for reasons that are:
technical,
connected with the protection of exclusive rights
It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011). This is due to Penny and Giles owning the proprietary rights to the old legacy equipment to be supported under the Contract. There are also technical reasons as the contract covers safety critical items which are already approved for use on the aircraft and the Authority does not hold the drawings or data packs for these items.
