FXPlus is looking to appoint a single provider for the supply of audio visual services over a 4-year period. The supplier should have appropriate skills and abilities, who can demonstrate an ability to assist the FXPlus Audio Visual Team to supply, supply and fit and provide full design and installation services as well as Consultancy, for Audio Visual projects, of varying sizes and complexity, as additions to the existing Audio Visual infrastructure, over the course of the term of the Contract at the Penryn Campus and Falmouth University's Wood Lane campus in Cornwall.

FXPlus is looking to appoint a single provider for the supply of audio visual services over a 4-year period. The supplier should have appropriate skills and abilities, be able to demonstrate an ability to assist the FXPlus Audio Visual Team to supply, supply and fit and provide full design and installation services as well as consultancy, for audio visual projects, of varying sizes and complexity, as additions to the existing audio visual infrastructure, at the Penryn Campus and Falmouth University's Wood Lane campus in Cornwall.

FXPlus reserves the right to request deposits, guarantees, performance bonds and other forms of appropriate security, either from the Bidders or another member of the Bidders corporate groups.
To the extent any of these are required, the relevant selection and tender requirements relating to these will be stated in the ITT.

FXPlus reserves the right to require, in the context of a consortium, bidders to take a particular legal form, or to require a single contractor to take primary liability or to require that each party undertakes joint and several liability. Changes to consortia and contracting structures must be notified to the contracting authority immediately, which may impose conditions on or reject the change if that is reasonably necessary to ensure FXPlus meets its legal or procurement obligations. (1) FXPlus reserves the right to restrict changes to a consortium membership and a Bidders proposed key subcontractor supply chain in accordance with requirements provided in the ITT.
(2) In full compliance with the Public Contract Regulations 2015 and the terms set out in the ITT, FXPlus reserves the right to change any part of the proposed contract and the procedure for awarding the proposed contract, to reject all or any tenders for the proposed contract and / or stop the process or cancel the procurement at any time. FXPlus also reserves the right not to award a contract at any time without any liability on its part.
(3) Please also note that FXPlus will be able to terminate the procurement process for any reason, including but not limited to: if there are not sufficient eligible Bidders.
(4) Nothing in this contract notice, ITT, contract documents, any other written communication to the potential Bidders / Bidders from FXPlus or its representatives and any oral communication to the potential Bidders / Bidders from FXPlus or its representatives, shall generate any contractual obligations or intention to create a contract prior to any signature of a final written contract.
(5) University of Exeter and Falmouth University are public authorities under the Freedom of Information Act 2000 (the Act) and the Environmental Information Regulations 2004 (EIR). As part of their duties under the Act and the EIR, University of Exeter and Falmouth University may disclose information to a person making a request unless the information is covered by an exemption under the Act or the EIR. University of Exeter and Falmouth University are required to determine whether the public interest in maintaining the exemption outweighs the public interest in disclosing this information. Bidders should state in their Tender responses whether or not they consider the information supplied should be exempted from disclosure to third parties under the Act or the EIR and should provide reasons for such views.
These views will be taken into consideration by University if Exeter and Falmouth University when deciding whether to disclose information. (Please see the ITT for further information).

Potential Bidders are to express their interest in this contract opportunity by following the instructions below:

B. Request to participate / tendering (i) Simultaneous requests to participate and tendering must be made by completion and return of the Invitation to Tender by the date and time set out in section IV.3.4 of this contract notice. Failure to submit a response to the Invitation to Tender will mean that the Bidders will progress no further in the procurement procedure for this contract opportunity.
(ii) Responses to the Invitation to Tender must be completed and submitted in accordance with the rules set out in the Invitation to Tender.

(iii) Bidders who decide not to submit a response to the Invitation to Tender for the contract opportunity having previously expressed an interest should inform FXPlus of its decision not to participate in the tender opportunity by using the, correspondence, facility in the project listing in the InTend e-tendering portal (https://in- tendhost.co.uk/Universityofexeter/aspx/Home ).

(iv) All documents relating to this contract opportunity (including, information memorandum and Invitation to

(9) All dates and time periods specified in this contract notice are FXPlus' present best estimates and FXPlus reserves the right to change these in accordance with the general principles deriving from the Treaty on the Functioning of the European Union and any UK and EU rules governing public procurement to which FXPlus has stated itself to be bound.
