It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 31(2)(b) of the Directive 2004/18/EC (Regulation 14(1)(b)(ii) of the UK Public Contract Regulations 2006). This is because of the exclusive rights in the product Boceprevir Drugs claimed by the economic operator in the form of a Marketing Authorisation Number as follows:

And that because of these rights the products cannot be supplied by another manufacturer as the above licences means that the supplier has exclusive rights to distribute the product and no other supplier can supply them.
