The City of Edinburgh Council wishes to establish a new partnership with a service provider for the provision of all of its Information, Communication and Technology ("ICT") services in line with The City of Edinburgh Council and Scottish Local Government ICT and Digital Strategies.
The City of Edinburgh Council's current ICT services are largely provided by 1 external supplier and the current contract is due to expire on 31.3.2016.
The ICT services that are required include all ICT services required by The City of Edinburgh Council at present and all future ICT service requirements for the duration of the contract. It is anticipated that The City of Edinburgh Council shall procure its future requirements from the service provider meaning that the partnership to be established must be able to adjust to The City of Edinburgh Council's developing requirements over time. The City of Edinburgh Council wishes to procure a service provider that it can work with over the duration of the contract to develop innovative solutions to its requirements and that can offer financial savings.
As such the nature of the partnership to be procured, the volume of services to be provided, the method by which those services are delivered and the specific type of services to be delivered may change over the lifetime of the contract. The service provider may also be required to participate in the transformation of the City of Edinburgh Council business and provide change management services in connection with the delivery of the ICT enabled services.
The scope of ICT Services to be delivered includes all ICT services presently delivered, those contemplated to be delivered by 2016 and all future ICT requirements of the City of Edinburgh Council and the contracting authorities named in this Contract Notice.
The City of Edinburgh Council is expressly looking for a solution to its ICT service provision which is sufficiently flexible and scalable so as to provide a long-term resolution that offer significant future-proofing.
The service provider may also have the opportunity to provide ICT services to the other contracting authorities which are named in this Contract Notice.
The ICT services concerned are for all of The City of Edinburgh Council's present and future ICT services and include, but are not limited, the examples of:
- Desktops and devices
- Wide Area Networks (WAN)
- Local Area Network (LAN)
- Platforms
- Data network
- Data centre
- Change Configuration Release Management (CCRM)
- Service design and transition
- Service desk
- Third party contract management
- Applications
- Security
- Projects
Sections I.2 and VI.3 and Annex A lists the contracting authorities that may wish to use the ICT Service Solution developed by the City of Edinburgh Council. For the avoidance of doubt the City of Edinburgh Council does not intend to purchase on behalf of those contracting authorities.

No specific legal form is required, but the City of Edinburgh Council reserves the right to either require all operators in a consortium to be jointly and severally liable or to require a consortium to take a particular legal form or require a single prime contractor to take primary liability. The City of Edinburgh Council reserves the right to not award any or part of this contract. All dates, values and time periods specified in this notice are only provisional and The City of Edinburgh Council reserves the right to change these.
The City of Edinburgh Council shall not be responsible for any costs, charges or expenses incurred by Applicants and accepts no liability for any costs, charges or expenses, irrespective of the outcome of the competition, or if the competition is cancelled or postponed.
Applicants are advised that The City of Edinburgh Council is subject to the Freedom of Information (Scotland) Act 2002 (the "Act"). If an Applicant considers that any of the information supplied as part of this procurement procedure should not be disclosed because of its commercial sensitivity, confidentiality or otherwise, they must, when providing this information, clearly identify the specific information they do not wish to be disclosed and clearly specify the reasons for its sensitivity. The City of Edinburgh Council shall take such statements into consideration in the event that it receives a request pursuant to the Act which relates to the information provided by the interested party. Please note, it is not sufficient to include a statement of confidentiality encompassing all the information provided in the response.
Section 11.3 - Please note that the duration of the contract listed is a maximum duration of 19 years. However the length of the duration of contract will be the subject of the Competitive Dialogue and may be between 7-19 years with a number of renewals, depending on the solution identified by The City of Edinburgh Council during dialogue.
Section 11.1.9 - Please note that variant bids may be accepted by The City of Edinburgh Council provided that their form and nature are approved by The City of Edinburgh Council in advance and are expressly permitted in the contract and procurement documents.
Section III - Under this project, the applicant will be required to actively participate in the achievement if social objectives relating to the participation in skills development, employment, and training programmes in accordance with the objectives and framework provided in the Scottish Government's document Community Benefits in Public Procurement and other added value contributions by the applicant in order to support community programmes promoted by The City of Edinburgh Council (to the extent that it is linked to the subject-matter of the contract). The City of Edinburgh Council will consider the applicants relevant experience in the delivery of community benefits. Furthermore, The City of Edinburgh Council may introduce contract performance conditions relating in particular to environmental and social/economic development to the extent that it is relevant to the subject matter of the contract.

The Pre Qualification Questionnaire (PQQ) is the only method by which The City of Edinburgh Council will accept requests to participate. The PQQ can be obtained via Public Contracts Scotland website www.publiccontractsscotland.gov.uk

For the avoidance of doubt, the "request to be selected to participate" at IV.3.4 shall comprise the return of the PQQ which is due to be returned by 31 March 2014 and will be issued no later than 20th February 2014

Precise information on deadline(s) for lodging appeals: A tenderer that suffers loss as a result of a breach of duty under the Public Contracts (Scotland) Regulations 2012 may bring proceedings in the Sheriff Court or the Court of Session. The City of Edinburgh Council (the Council) will have a minimum standstill period of 10 days before awarding the contract. The communication of the award decision notice will be sent by fax or e-mail to all tenderers on day 1 of the standstill period. If proceedings are started in the Sheriff Court or the Court of Session against the Council in respect of the decision to award the contract within the standstill period then the Council is prevented from awarding the contract. Post contract award the Sheriff Court or the Court of Session may (1) award damages provided proceedings are brought within 3 months from the date when the grounds for the bringing of the proceedings first arose (2) be entitled to issue an ineffectiveness order or impose a financial penalty on the Council. A claim for an ineffectiveness order must be made within 30 days of the Contract Award Notice being published in the OJEU or within 30 days of the date those who expressed an interest in or otherwise bid for the contract were informed of the conclusion of the contract or in any other case within 6 months from the date on which the contract was entered into.
