Dumfries and Galloway Council (the "Council") is committed to the promotion of waste prevention and education. The Council has made substantial investment in the enhancement of waste facilities in the region and is making progress towards the Scottish Government's Zero Waste targets. As part of its waste reduction project, the Council now requires to purchase optical/x-ray and screening technology for the detection and sorting of different coloured glass as part of the glass recycling process (the "Contract").
The Council is satisfied that Mogensen GmbH's turn-key glass processing plant product is the only product currently available on the market which fulfils the Council's technical requirements.
This VEAT notice relates to the purchase of supplies under the Contract by the Council from Mogensen GmbH.

The Council is satisfied that Mogensen GmbH's turn-key glass processing plant product is the only product currently available on the market which fulfils the Council's technical requirements. Accordingly, for technical reasons, Mogensen GmbH is the only economic operator able to provide the required supplies. The Council therefore considers that the grounds set out in Article 31(1)(b) of Directive 2004/18 and regulation 14(1)(a)(iii) of the Public Contracts (Scotland) Regulations 2012 are therefore satisfied, and that the Council is entitled, following the observance of a 10 days standstill period, to enter into the Contract with Mogensen GmbH. For the avoidance of doubt, following publication of this VEAT notice, the Council shall observe a 10 day standstill period, following which the parties shall enter into the Contract.
