Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below

    • absence of competition for technical reasons
Explanation:

Within England and Wales, the Procurement Directives are implemented into law through the Public Contracts Regulations 2015 (as amended). Regulation 32 (2)(b)(ii) of the Public Contracts Regulations 2015 allows for award without prior publication through the Negotiated Procedure where competition is absent for ‘technical reasons’ and the contract has been awarded on this basis.

A Deep Reactive Ion Etcher (DRIE) was required which could use both Bosch and Cryo etch processes common in DRIE. This is a small market and thorough market engagement identified that there was only one etcher available which combined the required flexibility in switching between processes and provided sufficient capacity to meet the requirement. Competition is therefore absent for technical reasons.
