The contract falls outside the scope of application of the Directive
The Contracting Authority is awarding the Contract to British Gas Trading Limited (BGTL) without prior publication of a contract notice as it is of the view that the requirements of the Public Contract Regulations2006 (as amended) do not apply in this case. This is because in order for the Regulations to apply the Contracting Authority must be in a position of seeking offers in relation to a proposed public works contract (Regulation 5(1) of the Regulations). The Contracting Authority is not in a position of seeking offers for the Contract from other economic operators besides BGTL as the Contract will only be viable and the works to be carried out under it will only be able to take place with the substantial funding (circa 60 million GBP) that BGTL has agreed to contribute to the project.
