1) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC

Additional works/deliveries/services are ordered under the strict conditions stated in the Directive.
It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 28(3)(a) of Directive 2009/81/EC (Regulation 16 (1)(b) (i) of the Defence and Security Public Contracts Regulations 2011). This is because Survitec Group Ltd is the original life raft (and spares) manufacturer and a different supplier would introduce material and different characteristics resulting in long term incompatibility difficulties with the existing equipment. In particular, the integration of new life rafts to existing aircraft platforms would cause operation, interoperability and maintenance difficulties because the training, spares, publication and aircraft clearances would differ between suppliers. There would be a disproportionate impact on costs and logistics to ensure the maintenance and operation of systems provided by different suppliers. the contract will be for a period of 5 years.
