The works/goods/services can be provided only by a particular tenderer for reasons that are:
connected with the protection of exclusive rights
It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Articles 28(1)(c) and 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011. This is because the equipment is proprietary to Nammo Vanasverken which is both the Original Equipment Manufacturer and holder of the intellectual property rights. No licences have been granted to any party, including the MoD, to obtain the drawings, specifications and/or other intellectual property necessary to carry out the design or manufacture on these items.
