IV.1)Type of procedure
Award of a contract without prior publication of a contract notice in the Official Journal of the European Union (in the cases listed in Section 2 of Annexes D1, D2 or D3 as appropriate)
Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with art. 28 of Directive 2009/81/EC
The works/goods/services can be provided only by a particular tenderer for reasons that are: technical, connected with the protection of exclusive rights
The DGM Project Team, part of the UK Ministry of Defence, intends to award a 3 year contract with a 2 year option to extend for the supply of specialist munitions from Edgar Brothers the exclusive UK agent for Black Hills.
It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Articles 28(1)(c) and 28(1)(e) of Directive 2009/81/EC (Regulations 16(1)(a)(ii) and 16(1)(a)(iii) of the Defence and Security Public Contracts Regulations 2011).
This is because the original drawings, associated confidential manufacturing data, projectile design, propellant and underlying technical know-how required belong to Black Hills. There is also a need for interoperability with other nations. The introduction of new rounds would need to be supported by a completely new Safety Case to provide the necessary confidence that the integrity of the rounds have not been compromised. This process would cause an untenable gap in current operational capability together with a disproportionate impact on time and cost.
This requirement provides direct support for military operations in Afghanistan. In addition, the rounds are proprietary to Black Hills who is the Original Equipment Manufacturer and holder of the intellectual property rights. No licences have been granted to any party, including the MoD, to obtain the drawings, specifications and/or other intellectual property necessary to carry out the design or manufacture on these items.
