1) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC

The works/goods/services can be provided only by a particular tenderer for reasons that are:
connected with the protection of exclusive rights
The ADATS Delivery Team, part of the UK Ministry of Defence, intends to award a contract to CAE (UK) plc for post-design services and in-service support to the VISSIM-TTF simulator systems. It is considered that this contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 31 of Directive 2004/18/EC (Regulation 14(1)(a)(iii) of the UK Public Contracts Regulations 2006). This is for reasons connected to the protection of exclusive design rights in the VISSIM-TTF equipment belonging to CAE (UK) plc as such services cannot be provided without access to that protected information.
